TERMS AND CONDITIONS

Acceptance of this document implies agreement to the following clauses:

FOR COMMISSIONS

For personal commissions.

I. Payment

1. If the Client decides to cancel or abandon the commission after it has started, the payment will NOT be refunded. However, before the work begins, the Client may request a full refund of the payment with no issue.2. The commission will begin once the Client has accepted the terms and made a payment of either 50% or 100% of the total. If additional work is requested during the process, any changes will be communicated and the quote will be adjusted accordingly. Upon completion of the work, the Client must complete payment before the final delivery.3. Available payment methods are:
International: PayPal or VGen.
National (Chile): Bank transfer, MACH or Mercado Pago.
4. For PayPal payments, an invoice will be sent through the platform, so I will need the email address linked to your account.

II. SERVICE AND RESOURCES

1. If, for personal reasons, I am unable to continue providing the service, I will deliver the progress made to the Client at no additional cost. In this case, the upfront payment will NOT be refunded.2. I commit to developing and managing the commission in a professional manner, provided that I have received all the necessary information and references from the Client. It is the Client’s responsibility to supply these materials before the work begins.3. It is recommended to send visual references (photos, illustrations, pose examples, color palettes, characters, etc.). The more references provided, the better the final result will be.4. Any text, logo or other external resource required for the commission must be provided by the Client. If these resources are not delivered, the work will not proceed, and the amount already paid will NOT be refunded.

III. DEVELOPMENT TIME

1. The Client may propose a deadline for delivery, as long as it is reasonable and aligned with the scope of the requested work. Commissions require time to develop proposals, make revisions, maintain ongoing communication and, in some cases, conduct prior research. If there are two or more commissions, or if the requested style is complex, the estimated delivery time will be longer.2. If I experience any delays for any reason, the Client will be informed in a timely manner. The Client may then choose to continue with the commission or cancel it. In case of cancellation, the progress made will be delivered, but the advance payment will NOT be refunded.3. If there is a waiting list, delivery times may be extended. You may check your position on the list at any time, keeping in mind that I must complete prior commissions before starting yours.

IV. PROPOSALS AND REVISIONS

1. During the sketch phase, a maximum of 2 to 3 proposals will be presented. If the Client requests additional proposals, an extra 50% of the total price will be charged for each one.2. Up to 3 revisions are allowed during the sketch and line art stages. Once these phases are approved by the Client, the coloring and rendering process will begin, during which NO further changes will be accepted.

V. DELIVERY

1. The work will be delivered in the formats requested by the Client. If no specific format is indicated, I reserve the right to choose the most appropriate one based on the commission’s requirements.2. Final delivery will be made via email or Google Drive.3. If the Client wishes to receive the editable source file of the artwork, an additional fee of 150% of the total value will apply.

VI. WORK PUBLICATION

1. If the Client does not wish the work to be published, they must inform me in advance. Unless stated otherwise, I reserve the right to share the work on social media or in my portfolio whenever I deem appropriate.2. The Client may publish the work on any website, as long as proper credit is given to me as the author.

VII. COMMERCIAL USE AND RIGHTS

1. If the illustration is to be used for commercial or merchandising purposes, an additional fee will be applied based on the type of commission.2. Full exclusivity of the artwork will incur an extra cost of 300% of the total value of the work.3. The artwork will include my signature as the creator. If the Client wishes to have it removed, an additional fee will apply. The signature is intended for personal-use works only.4. The use of the illustration for artificial intelligence (AI) training is strictly prohibited.

FOR PROJECTS

For works of illustration or graphic design in editorial, web, social media, branding, among others.

I. Payment

1. If the Client decides to cancel the project once it has already started and chooses not to continue working with Nival Designs, the advance payment will NOT be refunded.2. The project will begin once the Client has approved the quote and completed 50% of the initial payment. If additional work arises during the development process, Nival Designs will inform the Client and may adjust the budget, adding the corresponding costs to the final amount. If the additional amount is significant, it may be divided into a maximum of five payments.3. The final graphic material will be delivered after the remaining balance has been paid, including any previously agreed-upon additional costs.4. Available payment methods are:
International: PayPal or VGen.
National (Chile): Bank transfer, MACH or Mercado Pago.
5. For PayPal payments, an invoice will be sent via the platform, and the Client's PayPal-associated email address will be required.

II. SERVICE

1. In the event that Nival Designs discontinues its services due to personal reasons, it will only charge for the work completed up to that date. Additionally, Nival Designs agrees to deliver the editable file to the Client at no extra cost.2. Nival Designs commits to the creation, development, and management of the project within the previously agreed-upon timeframe, provided that all required materials and information are supplied by the Client in a timely manner. If all materials are received on time but the delivery deadline is not met, the Client may request a 10% discount on the agreed price.

III. DEVELOPMENT TIME

If the Client arbitrarily shortens the agreed deadlines or insists on speeding up the process, Nival Designs reserves the right to withdraw from the project, retaining payment for the work completed up to that point.

IV. PROPOSALS AND REVISIONS

1. During the preliminary stage of the project, a maximum of 2 to 3 proposals will be presented, depending on the type of work. If the Client requests additional proposals, they must pay 100% of the cost corresponding to each extra proposal.2. Any proposals presented by Nival Designs that are not accepted by the Client imply a waiver of all rights over them. These proposals will remain the sole property of Nival Designs, who may use or repurpose them freely at its discretion, as the original creator.3. A maximum of 3 minor revisions per stage will be accepted. If this limit is exceeded, the Client must pay 50% of the total project value for each additional revision. Revisions that involve a substantial change to the original design concept will not be considered.4. The Client is responsible for thoroughly reviewing the final design, including all text and data, before any printing, reproduction, or publishing process. Nival Designs will not be held responsible for errors resulting from omissions or incomplete reviews by the Client.

V. RESOURCES

Translations, texts, photographs, and any other resource or service required for the project, and not included directly within this agreement, must be provided by the Client. The project will not proceed until all necessary resources are delivered, and under no circumstances will the advance payment be refunded.

VI. DELIVERY

VII. COMMERCIAL USE AND RIGHTS

1. If a graphic piece is intended for commercial use, both Nival Designs and the Client must first agree on the licensing terms and corresponding commissions. If no agreement is reached, commercial usage rights will not be granted, and the work may only be used for personal or recreational purposes.2. All exploitation rights of the solution provided by Nival Designs will remain its property until the Client has completed 100% of the agreed payment.3. Full exclusivity of the product will incur an extra cost of 300% of the total value of the work.
